†Prepaid tuition plans do not qualify; “college savings plan” is limited to an education savings plan.
IF A PRIZE IS USED FOR A CHILD BENEFICIARY OTHER THAN MINOR WINNER:
Winner need not be the parent or legal guardian of Child Beneficiary. If a Winner is not the parent/legal guardian of Child Beneficiary, it is Winner’s sole responsibility to secure the parent/legal guardian’s approval of Winner’s selection of their child as Child Beneficiary.
Should a Winner be the parent/legal guardian of more than one (1) child who would qualify as Child Beneficiary, Winner must select only one (1) child as Child Beneficiary.
WHETHER PRIZE IS USED FOR A WINNER THEMSELVES AS BENEFICIARY OR FOR A CHILD BENEFICIARY (INCLUDING MINOR WINNER AS CHILD BENEFICIARY):
If a Winner or Child Beneficiary (as applicable) already has a 529 College Savings Plan, Winner must provide Sponsor/Administrator with all necessary and appropriate information so that Sponsor may effect the deposit of $80,000 to such Plan.
If a Winner or Child Beneficiary (as applicable) does not have a 529 College Savings Plan, Winner must first establish and open a Plan (with themselves as Beneficiary or Child Beneficiary, as applicable) as a pre-condition to award of the prize. (Upon a Winner’s request, Sponsor/Administrator will assist Winner in establishment of Plan; but, at all times, as between Winner on the one hand and Sponsor/Administrator on the other, Winner assumes full responsibility for selecting and opening a Plan including paying any and all administrative expenses in conjunction therewith. It is strongly advised that each Winner consult with a tax adviser or other financial professional BEFORE selecting and opening a Plan as a 529 College Savings Plan is an investment vehicle and, as such, is subject to risk of loss, tax penalties for improper use as well as other financial implications. Sponsor and Administrator will not under any circumstances provide investment advice to a Winner.) Once the Plan has been established and opened, Winners must provide Sponsor/Administrator with all necessary and appropriate information so that Sponsor may effect the deposit of $80,000 to the Plan.
Within thirty (30) days of Winner verification, Winners must establish and open a 529 College Savings Plan or provide Sponsor/Administrator with all necessary and appropriate information regarding an existing Plan so that Sponsor may effect the deposit of $80,000 to the Plan. (In addition, if a Winner is not the parent/legal guardian of Child Beneficiary, Winner must provide Sponsor/Administrator with adequate proof of parent/legal guardian’s approval of Winner’s selection of their child as Child Beneficiary within such thirty [30] day time period.) Absent extraordinary circumstances, as determined by Sponsor/Administrator in their sole discretion, prize will be forfeited and an alternate winner will be selected as set forth above, if a Winner fails to provide all such required information within the designated thirty (30) day period.
By depositing $80,000 to a 529 College Savings Plan subject to the requirements set forth above, Sponsor will have fulfilled its obligation to award the prize. Winners accept full responsibility for selecting the specific investments to be funded by the deposit of $80,000 to the 529 College Savings Plan. Without in any way limiting the foregoing, if the $80,000 deposit is lost in whole or in part due to the vicissitudes of investing, Sponsor and Administrator will NOT replenish same nor will a Winner or Child Beneficiary (as applicable) receive any other prize, compensation or consideration. In addition, Winners expressly acknowledges that establishing a Plan (if necessary) and/or maintaining a Plan will result in account maintenance fees, management fees and other costs, all of which are Winners’ sole responsibility.
UNDER NO CIRCUMSTANCES WILL A WINNER THEMSELF RECEIVE $80,000, AS THE PRIZE IS SPECIFICALLY INTENDED BY SPONSOR TO FUND THE EDUCATION OF WINNERS THEMSELVES OR A CHILD BENEFICIARY VIA DEPOSIT TO A 529 COLLEGE SAVINGS PLAN.
