CrunchLabs Creative Kit Platinum Ticket Sweepstakes
Official Rules
To enter the CrunchLabs Creative Kit Platinum Ticket Sweepstakes (the “Sweepstakes” or “Promotion”), you (on behalf of yourself and your child/children, as the case may be) must agree to and abide by these Official Rules (“Official Rules”).
NO PURCHASE NECESSARY.
1. Sponsor: CrunchLabs LLC, 649 Grape Avenue, Sunnyvale, CA 94087 (“Sponsor”).
2. Administrator: Probability LLC, 2 Woodstock Meadow Ln, PO Box 1484, Woodstock, NY 12498 (“Administrator”).
3. Eligibility: The Sweepstakes is open only to legal residents of the fifty (50) United States, and Washington, D.C. who are at least eighteen (18) years of age (or age of majority in their jurisdiction of residence, whichever is older) who are also the parent or legal guardian of at least one (1) child who is between 6 and 18 years of age (“Entrant”). For clarity, Entrant understands and agrees that they are entering the Sweepstakes on behalf of their child/children and not for themselves individually. (If you are not the parent or legal guardian of at least one [1] child who is between 6 and 18 years of age, do NOT enter the Sweepstakes as it is NOT intended for you. Past winners of the CrunchLabs Platinum Ticket Instant Win Game or CrunchLabs Platinum Diploma Sweepstakes are not eligible to win; for clarity, “past winners” refers to the parent/legal guardian and/or the child who won a prize in either the Camp CrunchLabs Contest, CrunchLabs Platinum Ticket Instant Win Game or CrunchLabs Platinum Diploma Sweepstakes. Any individuals (including but not limited to employees, consultants, independent contractors, and interns) who have, within the past six (6) months, performed services for Sponsor, Administrator, any organizations responsible for sponsoring, fulfilling, administering, advertising, promoting the Promotion or supplying the prizes and/or their respective parent, subsidiary, affiliated, and successor companies (collectively, the "Promotion Entities"), and immediate family and household members of such individuals, are not eligible to enter or win. In addition, Mr. Mark Rober and his immediate family and household members are not eligible to enter or win. "Immediate family members" shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses, regardless of where they live. "Household members" shall mean people who share the same residence at least three (3) months a year, whether related or not. Void where prohibited or restricted by law.
If selected as a potential winner, the Entrant and any potential guests over the age of eighteen (18) will be required to consent to a background check to verify eligibility; and, failure to sign such consents and authorizations and/or to furnish all required information will result in disqualification without compensation of any kind. In addition, Sponsor and Administrator reserve the right in their sole discretion to disqualify a potential winner or a potential guest (without explanation or compensation of any kind) if the results of such background check reveal that such potential winner or their potential guest(s) do not meet the Sweepstakes eligibility requirements or has been charged with a felony or misdemeanor, a crime of moral turpitude or an act of insurrection, or has committed any other act that might reflect negatively on Sponsor, Administrator or any of the Promotion Entities, as determined by the Sponsor and Administrator in their sole discretion. All such decisions of the Sponsor and Administrator are final and binding in all respects and not subject to appeal.
4. Sweepstakes Schedule: For eligible individuals, the Sweepstakes begins 12:00 AM Pacific Time (“PT”), November 1, 2025 and ends at 11:59 PM PT, October 31, 2026. (“Sweepstakes Period”). There will be twelve (12) separate entry periods (“Entry Period or collectively, “Entry Periods”) as described in the chart below.

For purposes of these Official Rules, all times are Pacific Time. Sponsor’s computer is the official time-keeping device for the Sweepstakes. Entry Limit applies to all methods of Entry and applies to each child of an Entrant. For example: for Entry Period 2, an Entrant who has three (3) children between the ages of 6-18 could submit up to six (6) entries [two entries per child).
5. How to Enter: There are two (2) ways to enter the Sweepstakes.
(a) Purchase/Online Method of Entry:
During the Sweepstakes Period, navigate the internet to CrunchLabs.com and purchase an annual or quarterly Creative Kit subscription† (Annual subscription consists of twelve (12) Creative Kits over a twelve (12) month period. Quarterly subscription consists of three (3) Creative Kits over a three (3) month period). For the avoidance of doubt, your annual or quarterly subscription must be active and in good standing for any Entries to be eligible. If your account is not active or in good standing any Entries submitted during that time will not be entered into the Sweepstakes or eligible to win a prize.
†Be sure you carefully review the terms of the subscription before purchasing same; without limitation, the annual subscription may be automatically renewed and your credit card, debit card or other payment instrument may automatically be billed by Sponsor.
You may be asked to consent to receive promotional emails from the Sponsor. Consenting to receive promotional e-mails is optional and is not required in order to submit an Entry in the Sweepstakes. Promotional emails from the Sponsor are subject to the Privacy Policy of the Sponsor, and you may opt out of receiving these emails at any time.
To enter, Entrant must take all of the following actions (each, a “Online Entry” and collectively, “Online Entries”):

Navigate the Internet to www.portal.crunchlabs.com ("Website"). On the Website, you must create a member profile for your child or each of your children (as applicable) who are between 6 and 18 years of age. Log in with the email and password used when purchasing / subscribing for CrunchLabs Creative Kit and provide your first and last name, and email address.

Find the upload box corresponding to a given Creative Kit. (Each of the twelve [12] Creative Kits will have its own specially designated upload box.) Upload a video (no more than sixty [60] seconds in length) of a mini-movie your child created with their Creative Kit (”Video”) to the upload box corresponding to the Creative Kit used in your child’s mini-movie (”Video”).Video must be submitted on-line within the CrunchLabs portal from a user/member profile (e-mail attachments will not be accepted) VIDEO MUST BE SOLELY YOUR CHILD’S ORIGINAL WORK WITH THE EXCEPTION OF ASSISTANCE BY YOU AND/OR A FAMILY MEMBER OR FRIEND IS ALLOWED.
If mini-movie created with a Creative Kit was made by or includes more than one (1) of your children or a friend, only the child listed in the member profile (as noted above) above will receive a prize if the Entry is selected as a prize winner.
Your Video will be referred to as the "Entry" and collectively as "Entries" throughout these Rules. Once submitted, Entry becomes the property of Sponsor.
For Entry to be eligible, the Video must be a mini-movie created by the child of Entrant with their Creative Kit. For the avoidance of doubt, the content of the Video/mini-movie will NOT be taken into account in the winner selection process (provided that the Entry complies with all instructions and is determined by Sponsor/Administrator to be in compliance with these Official Rules).
IF VIDEO IS UPLOADED TO THE “WRONG” UPLOAD BOX (I.E., ANY UPLOAD BOX OTHER THAN THE UPLOAD BOX CORRESPONDING TO THE CREATIVE KIT USED IN A CHILD’S MINI-MOVIE, VIDEO WILL NOT RESULT IN ENTRY.
Check the box agreeing to these Official Rules and then click the designated button to submit your Video(s). IF THIS BOX IS NOT CHECKED, YOUR VIDEO(S) WILL NOT RESULT IN ENTRY.
All Entries must be received by October 31, 2026 at 11:59:59 PM PT, subject to entry period deadlines set forth in Rule 4 above. An Entrant need not submit an Entry during the same Entry Period in which the corresponding Creative Kit was purchased/received. Proof of inputting information at the Website and uploading video file attachment to the Website is not considered proof of delivery to or receipt by Sponsor or Administrator or proof of Sweepstakes Entry.
VIDEOS MAY NOT INCLUDE ANY COPYRIGHTED MUSIC. Sponsor reserves the right to remove any music from a Video. Videos must be no longer than sixty (60) seconds.
Video file attachment must be in one of the following formats: MOV, MP4, AVI and WEBM. Total file size must be no larger than 50MB.
PARENT/LEGAL GUARDIAN MAY ASSIST THEIR CHILD/ENTRANT IN CREATING A MINI-MOVIE WITH THEIR CREATIVE KIT AND/OR A CHILD AND THEIR SIBLINGS/FRIENDS (AGED 6-18) CAN MAKE A MINI-MOVIE WITH THE CREATIVE KIT TOGETHER. HOWEVER ANY OTHER PERSON; AND, WITHOUT LIMITATION, GROUP/TEAM/JOINT ENTRIES ARE PROHIBITED. BY UPLOADING A VIDEO, YOU REPRESENT AND WARRANT THAT YOUR CHILD HAS FULLY COMPLIED WITH THIS REQUIREMENT AND THAT YOUR CHILDACTUALLY CREATED A MINI-MOVIE WITH THE CREATIVE KIT IN STRICT ACCORDANCE WITH THE CREATIVE KIT INSTRUCTIONS AS TO SAME INCLUDING ANY AND ALL SAFETY PRECAUTIONS.
Video must be created for the sole purpose of this Sweepstakes (DO NOT COPY OTHERS’ WORKS, IN WHOLE OR IN PART. YOU MUST OTHERWISE COMPLY WITH THE CONTENT GUIDELINES BELOW AND OTHER TERMS HEREIN). Video must comply with these Official Rules in all respects, including without limitation, the Content Guidelines below.
Multiple Entries and/or mass Entry attempts in violation of the above stated Entry Limit may result in disqualification of all Entries related to such person/member profile Entries must be manually key-stroked by the Entrant; use of automated devices or programs, or Entries by third parties by any method of entry, are prohibited. Entries that do not conform to or that violate these Official Rules or are submitted in any manner other than as stated in these Official Rules will be disqualified. Sponsor and Administrator are not responsible for late, corrupted, garbled, inaccessible/blocked, incomplete or misdirected Entries.
Once submitted, Videos become the sole property of Sponsor and cannot be modified by Entrant. By submitting an Entry, Entrant on behalf of him/her/themselves and his/her/their child/children gives permission to Sponsor and their designees and hereby grants Sponsor and their designees a royalty-free, irrevocable, perpetual, worldwide, sub-licensable, non-exclusive license (herein “License”) to use any portion of the Video in any media and through any means now known or hereafter devised, including without limitation, the World Wide Web, and to otherwise use the Video without compensation in accordance with the requirements of this Sweepstakes and the advertising, promotion, and publicity of the Sweepstakes, Sponsor’s products , and otherwise, as stated in these Official Rules (as solely determined by Sponsor); such use may include but is not limited to possible inclusion of Video of entrant’s child/children making the mini-movie with the Creative Kit. in Mark Rober videos for later Entry Period(s) in the Sweepstakes. Such License will be confirmed by Entrant upon Sponsor's' request and Entrant agrees to timely complete, sign and deliver any and all necessary documents, including without limitation, documents setting forth any licenses, releases and indemnities that Sponsor may require, without condition or compensation of any kind. Sponsor's failure to receive all documentation from all individuals within the prescribed timeframe, in each instance as required by Sponsor in their sole discretion, will result in the disqualification of the Entry.
If you choose to participate in the Sweepstakes by using your (compatible) wireless mobile
device, data rates may apply for each message sent or received from your handset according to the terms and conditions of your service agreement with your wireless carrier. Other charges may apply (such as normal airtime and carrier charges as well as charges for wireless Internet access) and may appear on your mobile phone bill or be deducted from your prepaid account balance. Wireless carriers' rate plans may vary, and you should contact your wireless carrier for more information on messaging rate plans and charges relating to your participation in the Sweepstakes. Mobile device service may not be available in all areas. Check your phone's capabilities for specific instructions.
(b) No Purchase Method of Entry:
To enter the Sweepstakes without purchase, on a 3”x5” card handprint your first and last name, your child's first and last name, complete mailing address, e-mail address, daytime phone number and date of birth, and mail along to: “Creative Kit Platinum Ticket Request”, c/o Probability LLC, c/o Probability, PO Box D, Social Circle, GA 30025-1559 (“Mail-In Entry”). Each valid 3”x5” card submitted will result in receipt of the number of Entries allotted per child in a given Sweepstakes Entry Period as set forth in Section 4 above. If submitting multiple Mail-in Entries in a given month, each 3”x5” card must be mailed separately. To be entered in the Sweepstakes a given month, the 3”x5” card must be postmarked by the first business day of the following month and received seven (7) days later. For November 2025, December 2025, January 2026, February 2026, July 2026 and October 2026 as the first day of the following month falls on a Saturday/Sunday/Holiday, the 3” x 5” card must be postmarked by the next business day and received seven (7) days later: for November 2025, 3” x 5” card must be postmarked by December 1, 2025 and received by December 8, 2025; for December 2025, 3” x 5” card must be postmarked by January 2, 2026 and received by January 9, 2026; for January 2026, 3” x 5” card must be postmarked by February 2, 2026 and received by February 9, 2026; for February 2026, 3” x 5” card must be postmarked by March 2, 2026 and received by March 9, 2026; for July 2026, 3” x 5” card must be postmarked by August 3, 2026 and received by August 10, 2026; for October 2026, 3” x 5” card must be postmarked by November 2, 2026 and received by November 9, 2026. For June 2026, due to the Independence Day Holiday, 3” x 5” card must be received by one (1) day later than the seven (7) day period set forth above; i.e., July 10, 2026. For August 2026, due to the Labor Day Holiday, 3” x 5” card must be received by one (1) day later than the seven (7) day period set forth above; i.e., by September 9, 2026.

IF SUCH AN ATTEMPT IS MADE, SPONSOR MAY DISQUALIFY ANY PERSON MAKING SUCH ATTEMPT AND SEEK DAMAGES TO THE FULLEST EXTENT OF THE LAW. FOR CLARITY, THE DISQUALIFICATION OF A CHILD WILL ALSO APPLY TO THEIR PARENT/LEGAL GUARDIAN WHO IS THE ENTRANT AND THE DISQUALIFICATION OF A PARENT/LEGAL GUARDIAN WHO IS THE ENTRANT WILL ALSO APPLY TO THEIR CHILD/CHILDREN.
6. Sweepstakes Entry Restriction/Content Guidelines: In addition to complying with all other
requirements of these Official Rules, each Online Entry must comply with the following guidelines (“Content Guidelines”). Videos must be original and created for the sole purpose of this Sweepstakes and must be submitted by the Entrant and show Entrant’s child/children mini-movie with their Creative Kit creation.
Participation must be effected in accordance with these Official Rules.
The Video: (i) must be the wholly original and sole creation of the Entrant’s child/children, and all right, title and interest including but not limited to the copyright in any Video, must be owned solely by the submitting Entrant in their capacity as parent/legal guardian of the child/children who created the Video; (ii) may not infringe upon any third party’s rights, including but not limited to, copyright, patent or trademarks/tradenames/logos, or rights of privacy or publicity, or contain material that is or may be considered misleading, inappropriate, indecent, obscene, hateful, tortious, defamatory, slanderous or libelous, or portray or depict any person, product or entity in a false light*; (iii) may not violate any law, rule or regulation; (iv) may not contain any virus, bugs, or other deleterious material; (v) may not contain content that, for example but is not limited to, reflects, advocates or promotes bigotry, racism, hatred, harm or exploitation of or against any class, group or individual, discrimination based on race, gender, religion, nationality, disability, sexual orientation or age, or actions or activities that are restricted, prohibited, illegal or unlawful (including without limitation, the consumption of alcohol or other controlled substances), defamatory statements, words or symbols widely considered offensive; (vi) may not be sexually explicit or suggestive, profane or pornographic or contain nudity; and each Entrant warrants and represents that his/her/their Video complies with all of those conditions. Videos cannot contain, among other things, the trademark, tradename or logo of any third party or entity or product, cannot name or describe any person (living, dead, or fictional) other than the Entrant, their child/children and Mr. Mark Rober, and cannot contain any material that is protected by copyright.
*Sponsor grants to each qualified Entrant (and their child/children) a limited, non-transferable, non-exclusive, non-sublicensable, revocable right to use its trademarks (as well as the Creative Kit) and the name, photograph, likeness, voice, and other indicia of persona of Mr. Rober solely for purposes of and limited to including them in (or, as the case may be, using them to create) theVideo ; such right and license will automatically expire without further act of any party at the expiration of the Sweepstakes Period, unless specifically extended on an individual basis by Sponsor in writing in its sole discretion. Any other use of Sponsor’s and/or its licensors’ trademarks and/or Mr. Rober's identity will be a violation of Sponsor’s or its applicable licensor’s or Mr. Rober's intellectual property rights. Sponsor’s items (including the trademarks) cannot be modified, adapted, or edited by entrant; the preceding only excludes modifications due to technological limitations or malfunctions.
7. Random Drawing/ Winner Selection/ Odds: Potential Prize Winners (each a "Grand Prize
winner") will be selected via a random drawing on or about seven (7) business days following the conclusion of the applicable Entry Period per the chart in Section 4 above. There will be a total of twelve (12) separate and distinct random drawings (each, a "Drawing" and collectively, "Drawings"). Each Drawing will consist of all eligible Entries received during the applicable Entry Period/month. All non-winning entries from a given Entry Period's Drawing WILL NOT be carried forward for any following Entry Period Drawing[s] (as applicable). For the avoidance of doubt, if an Online Entry is otherwise in compliance with these Official Rules (including but not limited to the Content Guidelines in Section 6 above), the content of the Online Entry (i.e., the Video) will NOT be taken into account in the winner selection process. Drawings will be conducted by Probability LLC, an independent judging organization/Administrator whose decisions are final and binding on all matters related to the Sweepstakes.
Odds of winning the prize (for a given Entry Period) depends on the total number of eligible subscription Entries and mail-in entries received during that Entry Period.
8. Winner Notification: Potential Grand Prize winners (that is, the parent/legal guardian who
submitted the Entry selected as a potential winner) will be notified by phone and email (if a potential Grand Prize winner enters via mail and does not include an email address on 3” x 5” card, they will be notified instead via phone in Sponsor’s/Administrator’s sole discretion) on or about ten (10) business days following the conclusion of the applicable Entry Period (as per the chart in section 4). If a potential Grand Prize winner's entry is from a purchase/online Entry, to be eligible to win a prize, potential Grand Prize winner must still have an active Creative Kit subscription in good standing at the time of the random drawing, winner notification, and prize fulfillment. Potential Grand Prize winners will be required to complete, sign and return within three (3) business days of date of notification an Affidavit of Eligibility, Liability Release and Indemnification, a Publicity Release where allowed by law, the necessary paperwork for a background check, and a non-disclosure agreement (“NDA”) as well as other documents that Sponsor may require (collectively the "Prize Claim Documents"). Failure to respond to the initial notification within three (3) business days after notification, return of email notification as undeliverable after two (2) attempts (if applicable), or failure to return the completed and signed Prize Claim Documents within the indicated time period may result in disqualification, prize forfeiture and selection of an alternate potential winner from among all remaining eligible Entries received during the corresponding Entry Period.
In the event of any dispute concerning the identity of any online Entrant (that is, the parent/legal guardian who submitted the Entry selected as a potential winner), the entry will be deemed submitted by the natural person who is the authorized account holder of the email address of the portal parent approver used to upload the Video and such individual must comply with these Official Rules. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational institution) that is responsible for assigning email addresses for the domain associated with the submitted email address.
9. Prizes and Approximate Retail Values (ARVs): There are a total of twelve
(12) Grand Prizes, with one (1) Grand Prize available per Entry Period/month of the Sweepstakes Period (each a “Grand Prize” or collectively “Grand Prizes”).
Grand Prize: Each Grand Prize winner will receive a CrunchLabs Platinum Ticket. A Platinum Ticket includes a (3) day/ (2) night trip for the winner and three (3) guests to visit CrunchLabs with Mark Rober (“Trip”). For the avoidance of doubt, Platinum Ticket itself has no retail value. ARV of each Grand Prize: $4,500. Trip includes:

Round-trip coach air transportation for four (4) from the major commercial airport closest to winner’s residence (as determined by Sponsor in its sole discretion) to Mountain View, California.

Accommodations for three (3) days / two (2) nights (one (1) standard room with quadruple occupancy) at a hotel to be selected by Sponsor, at its sole discretion.

Round-trip ground transportation between San Jose, San Francisco, or Oakland airport and the hotel and between hotel and CrunchLabs offices in Mountain View, California.
10. Additional Prize Restrictions: LIMIT: ONE (1) PRIZE PER PERSON/FAMILY/HOUSEHOLD.
Sponsor will provide Grand Prize winners with optional travel dates that align with Mark Rober’s schedule. All Grand Prize trips must be completed within one (1) year from date Grand Prize winner is confirmed but no later than October 31, 2027. Travel dates subject to approval by Sponsor in its sole discretion. Grand Prize winners may not receive his/her first choice of travel dates. All travel dates and arrangements are subject to change, availability and other restrictions. Once travel is booked, travel dates cannot be changed unless by Sponsor in its sole discretion. If a winner is unable to travel once the travel dates are booked, the prize will be forfeited in its entirety and Sponsor will have no further obligation to the Grand Prize winners.
If a winner’s residence is within one hundred (100) miles of Mountain View, California as determined by Administrator in its sole discretion, ground transportation will be provided in lieu of air travel and no substitute prize or compensation will be awarded.
Guest(s) must be immediate family members (as defined in Rule 3) of the Grand Prize winners. For the avoidance of doubt, if a friend or non immediate family member was involved in the Video for a winning Entry, they will not be able to be a guest or accompany the Grand Prize winner on their Trip. Guest(s) of Grand Prize winners (if a minor, his/her parent or legal guardian) must sign and return a Liability Release and a Publicity Release as well as an NDA (where legal) prior to issuance of travel documents. Any Guest who is at least eighteen years of age (or age of majority in their jurisdiction of residence, whichever is older) must also complete, sign and return the necessary paperwork for a background check. Any Guest who is a minor must be accompanied by his/her parent or legal guardian who must be the Grand Prize winner. If winner does not have three (3) guests accompany him/her on the Trip, the prize will otherwise be awarded in increments appropriate for actual number of travelers; and, in such event, no substitute prize or additional compensation will be awarded to winner. Multiple Grand Prize winners and their guests may be scheduled to attend the same Trip.
Participation of Mr. Rober in Trip is subject to availability. Sponsor’s representative(s) and other individuals may also be present at all times. If Mr. Rober is not available for any reason, the entire liability of Sponsor and Administrator will consist of the remaining elements of the Grand Prize. Conversely, should Mr. Rober participate in Trip, Mr. Rober may (or may not) in his sole discretion autograph items for winner and guest(s) and/or pose for videos or photographs for winners and guest(s).
Winners and all guests must conduct themselves at all times in an appropriate, well-behaved and socially responsible manner during the Trip. The preceding includes abiding by all applicable laws/regulations as well as private entity requirements established to prevent the spread of COVID-19/Coronavirus, including participation in activity being conditioned upon social distancing, wearing a facial covering, undergoing a COVID-19/Coronavirus test which comes back with a negative result or providing satisfactory proof of full vaccination against COVID-19/Coronavirus, as applicable. In addition, winner and all guests must act in a respectful and courteous manner toward Mr. Rober as well as following all instructions of CrunchLabs LLC as to visiting its offices, which may include one or more of the following: a prohibition on recording; agreement to be recorded; signing a confidentiality agreement; wearing appropriate attire. Any violation of the preceding requirements may result in immediate termination of Trip without liability of any kind to Sponsor or Administrator, as well as exposing winners and guests to potential legal liability.
Grand Prize Winners are solely responsible for all other expenses related to the trips not specified herein, including but not limited to baggage fees, meals, beverages, tips, taxes, and travel insurance. Grand Prize winners and guest(s) must travel together on specified itinerary, including same departure location and date, and return location and date or applicable trip may be forfeited in its entirety. Airline tickets are non-refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles. All airline tickets are subject to the vagaries of flight variation, work stoppages, and schedule or route changes. Sponsor is not liable for any expenses incurred as a consequence of flight cancellation/delay. Certain documentation and requirements may be necessary for travel, such as valid photo identification and/or Passport. Grand Prize winner and his/her guest(s) are solely responsible for any documentation and requirements and determining applicable procedures and restrictions prior to departure. Winners and guest(s) must provide their own transportation to and from their departure airport.
No substitution or transfer of prize (or portion thereof) except with Sponsor's permission or where required by law. If for any reason any announced prize (or portion thereof) becomes unavailable for any reason, Sponsor in its sole discretion may award a substitute prize/prize component of equal or greater value (except as otherwise indicated herein). Prize is not redeemable for cash. Federal, state and local taxes are the sole responsibility of the Grand Prize winners (that is, the parent/legal guardian who submitted the Entry selected as potential winner), who will receive a 1099 tax form reflecting the actual value of the Grand Prize.
11. Conditions and Limitations of Liability: By participating, each Entrant agrees (on behalf of themselves and their child/children, as appropriate): (a) to be bound by these Official Rules and the decisions of Sponsor and Administrator, which shall be final and binding in all respects; and (b) to release, discharge and hold harmless each of the Promotion Entities, Meta Platforms, Inc, X Corp., Google LLC, Snap Inc., TikTok Inc., Mark Rober personally, each of their respective advertising and promotion agencies, any entity responsible for the administration of this Promotion, each of the foregoing entities' respective parent, subsidiary, related, affiliated and successor companies, and each of their respective officers, directors, agents, representatives and employees (collectively, the "Released Parties") from any and all actions, claims, injury, loss or damage, including, without limitation, death and bodily injury, arising in any manner, directly or indirectly, in whole or in part, from participation in this Promotion or any Promotion-related activity (including without limitation, any travel related thereto), and/or from Entrant's (and their child/children’s, as applicable) acceptance, receipt, use or misuse of a Grand Prize (to the extent applicable) (including without limitation, any failure to pay taxes thereon).
By accepting prize, prize winners (on behalf of themselves and their child/children, as appropriate) grant Sponsor and its designees permission to use his/her and/or their child/children’s name, voice, likeness, photograph, Prize information, biographical data and city and state of residence on a winners' list (if applicable) and for programming, publicity and promotional purposes, worldwide in all forms of media now known or hereafter developed, in perpetuity, without further compensation unless prohibited by law. The preceding may also include recording of prize award/prize claim procedure as determined in the sole discretion of Sponsor. Sponsor and its designees are not obligated to use any of the above-mentioned information or materials but may do so and may edit such information or materials, at Sponsor's discretion, without further obligation or compensation. Promotion subject to the laws of the United States only. All federal, state and local laws and regulations apply.
12. Disputes: To the fullest extent permitted by law, Entrant (on behalf of themselves and their
child/children, as appropriate): agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or the awarding of prizes shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Northern District of California; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys' fees; and (3) under no circumstances will Entrant (or their child/children) be permitted to obtain awards for, and Entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant (or their child/children) and Sponsor in connection with the Promotion shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.
