CrunchLabs Build Box E-Blast Sweepstakes

Official Rules

To enter the sweepstakes, you must agree to and abide by these Official Rules.

  1. Sponsor: CrunchLabs LLC, 649 Grape Avenue, Sunnyvale, CA 94087 (“Sponsor”). 

  2. Administrator: Probability LLC, 2 Woodstock Meadow Ln, PO Box 1484, Woodstock, NY 12498 (“Administrator”).

  3. Eligibility: The CrunchLabs Build Box E-Blast Sweepstakes ("Promotion”) is open only to legal residents of the 50 United States and Washington, D.C. who are at least eighteen (18) years of age (or age of majority in their jurisdiction of residence, whichever is older) to whom an e-mail or other electronic communication (“Invite”) from Sponsor was specifically addressed. (The preceding includes but not is not limited to persons who signed up for the waiting list expressing their interest [without obligation] in possibly purchasing a CrunchLabs  build box subscription.) Invite is not transferable and any attempted transfer of Invite is void and will result in disqualification. Members of the general public (i.e., all persons who did not receive an Invite from Sponsor) are not eligible to enter or win. Without limitation, any individuals (including but not limited to employees, consultants, independent contractors, and interns) who have, within the past six (6) months, performed services for Sponsor, Administrator, any organizations responsible for sponsoring, fulfilling, administering, advertising, promoting the Promotion or supplying the prizes and/or their respective parent, subsidiary, affiliated, and successor companies (collectively, the "Promotion Entities"), and immediate family and household members of such individuals, are not eligible to enter or win. In addition, Mr. Mark Rober and his immediate family and household members are not eligible to enter or win. "Immediate family members" shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses, regardless of where they live. "Household members" shall mean people who share the same residence at least three (3) months a year, whether related or not. Void where prohibited or restricted by law.

  4. How to Enter: Following the instructions in the Invite, use the provided link to sign up for (i.e., commit to purchase) a CrunchLabs build box subscription (once available)† between  November 1, 2022 and December 7, 2022. Upon committing to purchase a CrunchLabs build box subscription by providing your payment information, you will receive one (1) entry into the Promotion ("Entry").  Email address used to subscribe must match the email address from Invite.

    Be sure to carefully review the terms of the subscription before purchasing same; without limitation, the monthly and annual subscription will be automatically renewed and your credit card, debit card or other payment instrument will automatically be billed by Sponsor.

    If your payment instrument is rejected or if you seek to reverse payment, Entry is void. No Entry will be received if you sign up for a CrunchLabs build box subscription other than by using the link provided in the Invite.

    No Purchase Method of Entry (“AMOE”): To enter the Sweepstakes without signing up for/committing to purchase a CrunchLabs build box subscription (and, for persons who received an Invite because they did sign up for the waiting list expressing their interest [without obligation] in possibly purchasing a CrunchLabs  build box subscription, even remaining on such waiting list), on a 3”x5” card handprint your first and last name, zip code, e-mail address, and daytime phone number, and mail  to: “CrunchLabs Build Box E-Blast Request”, c/o Probability LLC, , PO Box D, Social Circle, GA 30025-1559. Email address must match the email address from Invite. To be eligible, the request must be postmarked by 12/7/22 and received by 12/14/22.

    Limit: one (1) Entry per person regardless of the method of Entry (even if a person received more than one [1] Invite).

    In the unlikely event that Sponsor sells out its allotted inventory of CrunchLabs build box subscriptions prior to December 7, 2022, all eligible persons who received an Invite will be notified by Sponsor accordingly and that (a) until December 7, 2022, they will only be able to enter the Sweepstakes via the No Purchase Method of Entry, if they have not done so already and (b) separate and apart from Sweepstakes entry, they may sign up for the new waiting list, without obligation, to possibly purchase a CrunchLabs build box subscription. 

  5. Random Drawing and Odds: Winners will be randomly selected on or about 12/15/22 from among all eligible Entries received. The drawing will be conducted by Administrator. Administrator’s decisions are final and binding on all matters related to the Sweepstakes.

    Odds of winning depend on the number of eligible Entries received.

  6. Winner Notification & Verification: Potential winners will be notified by e-mail and/or mobile phone (if provided) on or about December 15, 2022. Failure to respond to the initial verification e-mail within three (3) business days after notification or return of e-mail notification as undeliverable after three (3) attempts may result in disqualification. (If applicable, failure to respond to phone call after two [2] attempts may result in disqualification; for clarity, messages will NOT be left). Potential winners may be required to complete, sign and return within three (3) business days of date of notification an Affidavit of Eligibility, Liability Release and Indemnification, and a Publicity Release where allowed by law, as well as other documents that Sponsor may require (collectively the "Prize Claim Documents"). If the Prize Claim Documents are not returned to Administrator within the specified time period (if applicable), or if any prize notification or prize is returned as non-deliverable, or if a potential winner is found to be ineligible or otherwise not in compliance with these Official Rules, or declines the prize for any reason prior to award, prize may be forfeited and potential winner may be disqualified and an alternate winner may be selected from all remaining eligible Entries received. 

    In the event of any dispute concerning the identity of any entrant, the Entry will be deemed submitted by the natural person who is the authorized account holder of the e-mail account to which the Invite was sent by Sponsor. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

  7. Prizes and Approximate Retail Values (ARVs): 
    Grand Prize (ten [10] winners): Each Grand Prize winner will receive an annual CrunchLabs build box subscription and a video chat experience with Mark Rober (subject to availability and restrictions, as discussed below) ARV of each Grand Prize: $299.40.  Annual CrunchLabs build box subscription will be awarded in the form of a check in the name of the Grand Prize Winner regardless of whether (or not) winner actually purchased a CrunchLabs build box subscription. There is no retail value associated with the video chat experience portion of the Grand Prize.

  8. Additional Prize Restrictions: LIMIT: ONE (1) PRIZE PER PERSON/FAMILY/HOUSEHOLD. 
    The video chat experience with Mark Rober consists of one ten to fifteen (10-15) minute conversation to be conducted via video conference* on a mutually agreed-upon date and time subject to Mark’s professional availability. Sponsor will determine the agenda of the video chat experience, Limit of seven (7) people allowed to participate in the video chat experience. Each participant (if a minor in his/her jurisdiction of residence, his/her parent or legal guardian) must sign and return a publicity release prior to the video chat experience.

    If a Grand Prize winner is unavailable on such date/time once scheduled for any reason, the video chat experience will be forfeited and the Sponsor’s liability to the Grand Prize winner will be limited to award of the CrunchLabs build box subscription (i.e., the check for $299.40). Video chat experience is planned to last approximately ten to fifteen (10-15) minutes; but, should duration of video chat be less than ten (10) minutes, Sponsor (as well as Administrator) shall not have any liability of any kind. Video chat experience may not be private and may include one or more representatives of Sponsor. Sponsor and/or their designees may record the video chat experience for among other purposes, possible use for advertising/promotional purposes. To the fullest extent permitted by law, each Grand Prize winner grants to Sponsor and their designees any and all copyrights, trademarks, rights of privacy, publicity or other intellectual property or other legal or moral rights in the video chat experience, without further consent or compensation of any kind. Each Grand Prize winner agrees upon the request of Sponsor and/or their designees and without compensation of any kind, to execute any additional documents so as to effect, record or perfect such grant of rights. Each Grand Prize winner agrees to act in an appropriate, well-behaved and respectful manner toward Mark during and in conjunction with the video chat experience. Failure to do so (as determined by Sponsor and Mark himself in their sole discretion) will result in immediate termination of the video chat experience. In all cases where video chat experience is so terminated, Sponsor (as well as Administrator) shall not have any liability to Grand Prize winner under any legal theory relative to the video chat experience and reserves the right to withhold the build box subscription portion of the prize (i.e., the check for $299.40) as well as seek legal sanctions if they see fit. A Grand Prize winner further agrees not to record, stream, otherwise publish, or make available to any third party the video chat experience.

    *If Grand Prize winner does not have access to video conference technology, video chat experience will instead be conducted via telephone.

    No substitution or transfer of prize (or portion thereof) except with Sponsor's permission or where required by law. Federal, state and local taxes are the sole responsibility of the Grand Prize winner.

  9. Limitation of Liability: Released Parties (as defined below) are not responsible for failed, partial or garbled computer transmissions, or for technical failures of any kind affecting the Promotion in any manner, including but not limited to electronic malfunction or damage of any network, hardware or software. In the event of any discrepancy between the provisions of these Official Rules and the Invite, the provisions of these Official Rules shall prevail and govern. If for any reason the Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud or technical failures beyond Sponsor’s control that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion (including entries or otherwise), Sponsor reserves the right, in its sole discretion, to disqualify any individual, whether or not the individual is a participant in the Promotion, who tampers with the entry process, and to terminate, modify or suspend the Promotion. In such event, Sponsor reserves the right to conduct the Sweepstakes and award prizes by means of a random drawing from among all non-suspect eligible entries received prior to and/or after (as appropriate) the action taken by Sponsor or otherwise in a manner which is fair, appropriate and consistent with these Official Rules, as determined by Sponsor in its sole discretion. Invitees will be notified of termination/modification/suspension of Promotion via email. No responsibility is assumed for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or loss, destruction or unauthorized access to, or alteration of, entries; or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail, electronic entry, communications of any kind, or participation to be received on account of technical problems or traffic congestion on the Internet or at any website/platform, or any combination thereof, including any injury or damage to any person's computer or other device related to or resulting from participation in or downloading any materials from this Promotion. Failure of Sponsor or Administrator to enforce any provision of these Official Rules shall not constitute the waiver of such provision. All federal, state and local laws and regulations apply. 


  10. Release of Liability: By participating, each entrant agrees: (a) to be bound by these Official Rules and the decisions of Sponsor and Administrator, which shall be final and binding in all respects; and (b) to release, discharge and hold harmless each of the Promotion Entities, Mark Rober personally, each of their respective advertising and promotion agencies, any entity responsible for the administration of this Promotion, each of the foregoing entities' respective parent, subsidiary, related, affiliated and successor companies, and each of their respective officers, directors, agents, representatives and employees (collectively, the "Released Parties") from any and all actions, claims, injury, loss or damage, including, without limitation, death and bodily injury, arising in any manner, directly or indirectly, in whole or in part, from participation in this Promotion or any Promotion-related activity (including without limitation, any travel related thereto), and/or from entrant's acceptance, receipt, use or misuse of the Prize.

  11. Publicity Grant: By accepting prize, prize winners grant Sponsor and its designees permission to use his/her name, voice, likeness, photograph, Prize information, biographical data and city and state of residence on a winners' list (if applicable) and for programming, publicity and promotional purposes, worldwide in all forms of media now known or hereafter developed, in perpetuity, without further compensation unless prohibited by law. The preceding may also include recording of prize award/prize claim procedure as determined in the sole discretion of Sponsor. Sponsor and its designees are not obligated to use any of the above-mentioned information or materials but may do so and may edit such information or materials, at Sponsor's discretion, without further obligation or compensation. Promotion subject to the laws of the United States only. All federal, state and local laws and regulations apply. 

  12. Disputes: To the fullest extent permitted by law, Entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or the awarding of prizes shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Northern District of California; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys' fees; and (3) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant and Sponsor in connection with the Promotion shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.

  13. Winners' List: For the names of winners, mail a self-addressed, stamped envelope to: CrunchLabs Build Box E-Blast Winners, c/o Probability, PO Box D, Social Circle, GA 30025-1559. All such requests must be received by 12/7/22. Winners’ list will be available after 1/6/2023.
